Your Car Was Repaired. The Value Was Not.

After an accident, your vehicle may look completely repaired.

Fresh paint. New parts. Clean inspection report.

But when it is time to sell the car, suddenly everyone becomes an expert in "painted parts" and "replaced panels."

That difference between the pre accident market value and the post repair market value is called vehicle depreciation loss.

And yes, it is a legally recognized type of damage under Turkish law.

Who Pays?

Usually:

  • the driver who caused the accident
  • the vehicle owner/operator
  • most importantly, the traffic insurance company

In Practice

In practice, the claim is generally directed against the compulsory traffic insurance policy first.

Even if your cousin's friend living somewhere in Europe says "you probably do not need a lawyer for this."

Time Limits Matter

In general, depreciation claims should be filed within 2 years after the accident.

And honestly, waiting too long in Türkiye rarely becomes financially smarter.

Inflation already does enough damage by itself.

Court or Arbitration?

Some cases go to court.

Many go through insurance arbitration.

Arbitration is usually faster. Courts may become necessary in more disputed files.

The important part is understanding which path makes more sense for the specific case instead of blindly starting a process.

The paperwork itself is not usually the difficult part.

The real issue is making sure the loss is calculated correctly and the process is managed properly.

Is a Lawyer Necessary?

Legally, no.

Practically... sometimes very much yes.

Insurance companies occasionally make surprisingly "reasonable looking" offers which become much less reasonable after proper calculation.

The goal is not only opening a file.

The goal is making sure the actual loss is fully understood.

What Do We Actually Do?
